These Terms of Service ("Terms") constitute a legally binding agreement between you ("you", "your", "User") and Fortic AB, org.nr 556852-0042, a company incorporated in Sweden ("we", "us", "our", "Company"), governing your access to and use of the website located at studentcompetitions.com (the "Service"). By accessing or using the Service, you acknowledge that you have read, understood, and agree to be bound by these Terms. If you do not agree, you must discontinue use of the Service immediately.
1. Definitions
"Competition" means any contest, challenge, award, scholarship, or similar opportunity listed on the Service.
"Organizer" means any individual or entity that submits a Competition for publication on the Service.
"Subscriber" means any individual who registers to receive email communications from the Service.
"Boost" means the paid promotional feature that provides enhanced visibility for a Competition on the Service for a defined period.
"Gate Removal" means the paid feature that permanently removes the email subscription requirement for visitors accessing a specific Competition listing on the Service.
"Content" means any text, images, data, or other materials submitted to, displayed on, or transmitted through the Service.
2. Eligibility
You must be at least sixteen (16) years of age to use the Service. If you are using the Service on behalf of an organization, you represent and warrant that you have the authority to bind that organization to these Terms. By using the Service, you represent that you meet these eligibility requirements.
3. Description of the Service
StudentCompetitions.com is a curated directory and discovery platform for student competitions worldwide. The Service enables Organizers to submit Competitions for review and publication, allows students and other visitors to browse and discover Competitions, and provides email subscription functionality for competition notifications. We act solely as an intermediary platform and are not an organizer, sponsor, or co-host of any Competition listed on the Service.
4. Competition Submissions
4.1 Submission and Review. All Competition submissions are subject to editorial review at our sole discretion. We reserve the right to reject, modify, or remove any submission for any reason, including but not limited to submissions that are misleading, fraudulent, inappropriate, or otherwise inconsistent with the purpose and standards of the Service.
4.2 Email Verification. Organizers must verify their email address before a submission will be reviewed. Unverified submissions may be automatically deleted after a reasonable period.
4.3 Accuracy. Organizers are solely responsible for the accuracy, completeness, and legality of the information provided in their submissions, including competition rules, deadlines, prize descriptions, and eligibility criteria. You represent and warrant that you have the right and authority to submit the Competition and that no submission infringes the intellectual property rights of any third party.
4.4 License Grant. By submitting Content to the Service, you grant us a non-exclusive, worldwide, royalty-free, perpetual, irrevocable license to use, reproduce, modify, adapt, publish, display, and distribute such Content in connection with the operation and promotion of the Service. This license survives the removal of the Competition from the Service.
4.5 No Endorsement. Publication of a Competition on the Service does not constitute an endorsement, recommendation, or guarantee by us regarding the Competition, the Organizer, or any prizes offered.
4.6 Withdrawal of Submissions. To request withdrawal of a submitted Competition, the Organizer must contact us via email. Withdrawal requests will be processed within a reasonable time. If an Organizer withdraws a Competition before it has been published, any associated paid services will be cancelled and refunded.
5. Paid Services
5.1 Boost and Gate Removal. We offer optional paid features, including Boost and Gate Removal. Pricing, duration, and availability of paid features are subject to change at our sole discretion without prior notice. Current pricing and terms are displayed at the time of purchase. Gate Removal applies to a single Competition listing and remains active for the duration of that Competition's publication on the Service.
5.2 Payment Processing. Payments are processed by Stripe, Inc. ("Stripe"). By making a purchase, you agree to Stripe's terms of service. We do not store credit card numbers or other sensitive payment credentials.
5.3 Boost Queue. Boost placements are limited. If the maximum number of concurrent Boosts is active at the time of purchase, your Boost will be placed in a queue. Queued Boosts are activated on a first-come, first-served basis as slots become available. If your Competition deadline passes before the Boost is activated, the Boost will be cancelled and a full refund issued automatically.
5.4 Refunds. If a Competition submission is rejected during editorial review after payment for Boost or Gate Removal, the payment will be cancelled and a full refund issued automatically. If a Boost purchase has been placed in the Boost queue and the Competition deadline passes before the Boost is activated, the Boost will be cancelled and a full refund issued automatically.
Refunds apply only to Competitions that have not yet been published on the Service. Once a Competition has been published, purchases for Boost or Gate Removal are final and non-refundable.
5.5 Taxes. All prices are exclusive of applicable taxes unless stated otherwise. You are responsible for any taxes, duties, or levies applicable in your jurisdiction.
6. Email Subscriptions
6.1 Consent. By subscribing to our email communications, you consent to receive newsletters and notifications about Competitions matching your selected interests. You may withdraw your consent and unsubscribe at any time by clicking the unsubscribe link in any email or by contacting us.
6.2 Email Gate. Certain Competition links may require visitors to provide an email address before being redirected to the external competition page. By submitting your email address through the Email Gate, you consent to receiving communications from the Service as described in our Privacy Policy.
7. Intellectual Property
7.1 Our Property. The Service, including its design, layout, code, trademarks, logos, and editorial content (excluding user-submitted Content), is the exclusive property of Fortic AB and is protected by Swedish and international copyright, trademark, and other intellectual property laws. No right or license is granted to you except as expressly set forth in these Terms.
7.2 Restrictions. You may not (a) copy, modify, or create derivative works based on the Service; (b) reverse-engineer, decompile, or disassemble any aspect of the Service; (c) scrape, crawl, or use automated means to access the Service except via our public API in accordance with its documentation and rate limits; or (d) use the Service for any unlawful purpose or in a manner that could damage, disable, or impair the Service.
8. API Usage
We provide a public read-only API. Access to the API is subject to rate limiting and fair use. We reserve the right to modify, restrict, or discontinue API access at any time without notice. You shall not use the API to build a substantially similar service using our data as the primary source, or to systematically download the entirety of our database.
9. Prohibited Conduct
You agree not to:
- Submit false, misleading, or fraudulent Competition information;
- Impersonate any person or entity, or misrepresent your affiliation with any person or entity;
- Submit content that is defamatory, obscene, hateful, discriminatory, or otherwise objectionable;
- Upload files containing viruses, malware, or other harmful code;
- Attempt to gain unauthorized access to any part of the Service, its servers, or connected systems;
- Circumvent or attempt to circumvent any security measures, rate limits, or access controls;
- Use the Service to send unsolicited commercial communications (spam);
- Interfere with or disrupt the integrity or performance of the Service;
- Harvest, collect, or store personal data of other users without their consent.
10. Disclaimer of Warranties
THE SERVICE IS PROVIDED ON AN "AS IS" AND "AS AVAILABLE" BASIS WITHOUT WARRANTIES OF ANY KIND, WHETHER EXPRESS, IMPLIED, STATUTORY, OR OTHERWISE. TO THE FULLEST EXTENT PERMITTED BY APPLICABLE LAW, WE DISCLAIM ALL WARRANTIES, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, AND NON-INFRINGEMENT.
WE DO NOT WARRANT THAT THE SERVICE WILL BE UNINTERRUPTED, ERROR-FREE, OR SECURE, OR THAT ANY DEFECTS WILL BE CORRECTED. WE MAKE NO REPRESENTATIONS OR WARRANTIES REGARDING THE ACCURACY, COMPLETENESS, OR RELIABILITY OF ANY COMPETITION INFORMATION PUBLISHED ON THE SERVICE. YOUR USE OF THE SERVICE AND RELIANCE ON ANY CONTENT IS AT YOUR SOLE RISK.
11. Limitation of Liability
TO THE MAXIMUM EXTENT PERMITTED BY LAW, IN NO EVENT SHALL FORTIC AB, ITS DIRECTORS, EMPLOYEES, AGENTS, OR AFFILIATES BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING BUT NOT LIMITED TO LOSS OF PROFITS, DATA, BUSINESS OPPORTUNITIES, OR GOODWILL, ARISING OUT OF OR IN CONNECTION WITH YOUR USE OF OR INABILITY TO USE THE SERVICE, EVEN IF WE HAVE BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.
OUR TOTAL AGGREGATE LIABILITY FOR ALL CLAIMS ARISING OUT OF OR RELATING TO THESE TERMS OR THE SERVICE SHALL NOT EXCEED THE GREATER OF (A) THE AMOUNT YOU HAVE PAID TO US IN THE TWELVE (12) MONTHS PRECEDING THE CLAIM, OR (B) ONE HUNDRED UNITED STATES DOLLARS (USD 100).
12. Indemnification
You agree to indemnify, defend, and hold harmless Fortic AB and its officers, directors, employees, and agents from and against any and all claims, liabilities, damages, losses, costs, and expenses (including reasonable attorneys' fees) arising out of or in connection with: (a) your use of the Service; (b) any Content you submit; (c) your violation of these Terms; or (d) your violation of any rights of a third party.
13. Third-Party Links and Content
The Service contains links to third-party websites, including Competition pages operated by Organizers. These links are provided for convenience only. We have no control over, and assume no responsibility for, the content, privacy practices, or availability of third-party websites. Your interaction with any third-party website, including any Competition you enter, is solely between you and that third party.
14. Termination
14.1 By Us. We may suspend or terminate your access to the Service at any time, with or without cause, with or without notice. Without limiting the foregoing, we may remove any Competition, reject any submission, or block any user who we believe has violated these Terms or whose conduct we deem harmful to the Service or other users.
14.2 Effect of Termination. Sections 4.4 (License Grant), 7 (Intellectual Property), 10 (Disclaimer), 11 (Limitation of Liability), 12 (Indemnification), 15 (Governing Law), and this Section 14.2 shall survive termination of these Terms.
15. Governing Law and Dispute Resolution
15.1 Governing Law. These Terms shall be governed by and construed in accordance with the laws of Sweden, without regard to its conflict of laws principles.
15.2 Jurisdiction. Any dispute arising out of or in connection with these Terms that cannot be resolved amicably shall be submitted to the exclusive jurisdiction of the courts of Stockholm, Sweden.
15.3 EU Online Dispute Resolution. If you are a consumer in the European Union, you may use the European Commission's Online Dispute Resolution platform.
16. Modifications to These Terms
We reserve the right to modify these Terms at any time. Changes will be effective upon posting the revised Terms on this page with a new effective date. Your continued use of the Service after any modification constitutes your acceptance of the revised Terms. We encourage you to review these Terms periodically.
17. General Provisions
17.1 Entire Agreement. These Terms, together with our Privacy Policy and Cookie Policy, constitute the entire agreement between you and us regarding the Service.
17.2 Severability. If any provision of these Terms is held to be invalid or unenforceable, the remaining provisions shall continue in full force and effect.
17.3 Waiver. Our failure to enforce any right or provision of these Terms shall not constitute a waiver of such right or provision.
17.4 Assignment. You may not assign or transfer these Terms or your rights hereunder without our prior written consent. We may assign these Terms without restriction.
17.5 Force Majeure. We shall not be liable for any failure or delay in performing our obligations where such failure or delay results from circumstances beyond our reasonable control, including but not limited to natural disasters, acts of government, internet disruptions, or failures of third-party service providers.
